1. Dmodelz: the website www.dmodelz.com and the persons who own and operate it.
2. The website: the website www.dmodelz.com
3. Terms of use: Terms of use of the website www.dmodelz.com.
4. Services: the services the website www.dmodelz.com provides to its users (access to news, articles, opportunity to download 3D-models, etc.)
5. Resources: all materials published in the website www.dmodelz.com (news, articles, database with 3D-models, renderings, etc.)
6. Model: computer generated digital three-dimentional model, provided in electronic files, available on the website www.dmodelz.com.
7. File: electronic file, in which a three-dimensional Model is stored.
8. Image: computer generated image of a Model, showing it's content, form, shape and level of detailness.
9. Real Item: a real/original physical item/object which is subject to copyright owned by the relevant third party – author, trademark owner or owner of intellectual property.
10. User: any physical or legal entity which uses the website www.dmodelz.com or the resources it provides.
11. Contract: the contract between Dandelien Creations Ltd. (the owner of Dmodelz) and the User whereby the User is obliged to keep the Terms of use of the Contract.
12. Terms of use: all conditions described in this document.
13. Registration: the process of registering the user in the Dmodelz’s system thereby creating his profile.
14. Profile: the profile of the user in the Dmodelz’s system which is created upon his registration in the website. The Profile contains some personal data. The profile is not visible to other users; the purpose of the profile is to allow the user to use more options of the system of the site www.dmodelz.com.
15. Personal data: the data provided by the user when signing up in the website www.dmodelz.com.
16. Billing information: The information, which the User provides before or by buying Models. The User is obliged to provide correct information. Providing false information can lead to administrative and/or criminal liability.
17. Cart: section on this Website, where the User stores selected paid Models temporarily, before the User pays and downloads them.

 General conditions

1. The Terms of use of Dmodelz represent a Contract between Dmodelz and the User. By accessing and using Dmodelz, the User agrees to comply with the Terms of use.
2. The present Contract is in force during the use of Dmodelz, as well as the use of the Resources it provides.
3. In case the User does not wish to honor the Terms of use, the User has no right to use Dmodelz and the Resources it provides.
4. In case the User stops using Dmodelz and the Resources, the copyrights, as well as the prohibition to distribute the Resources in any form remain in force.
5. Dmodelz offers exclusively services with informative nature. Dmodelz provides the User with temporary limited unexclusive access to the Services and the Resources.
6. The User can buy and download paid Models without making Registration. To gain access and download free Models, the User should firstly sign up and make Profile.
7. When buying paid Models, the User must fill in correct Billing information.
8. The User can email any questions, suggestions, comments, complaints or other messages one may have to admin@dmodelz.com.
9. Any outstanding issues not settled under the current Terms of use, will be treated under the existing Bulgarian legislation.
10. The User can send suggestions and enquiries about specific models using the respective contact form or via e-mail.
11. The User is obliged to inform Dmodelz in case he becomes aware of any violation of the current Terms of use by third persons.
12. Dmodelz provides the User access to the Website, while the User should ensure on his own proper internet connection, computer, connection to the electric mains etc.
13. The User is obliged to answer any questions received by Dmodelz via email regarding possible violation of the Terms of use in due time.
14. The User is obliged not to violate the copyrights of Dmodelz and/or the copyrights of third persons on Real Items.
15. In order to use more functions and/or download free Models from Dmodelz, the User should create his Profile in Dmodelz. The User’s Profile is not visible to other Users.

Characteristics and Quality of the Models

1. All Models in this Website are computer generated digital three-dimensional models, provided within an electronic file.
2. The Users can use a Model only after downloading it.
3. A Model can be downloaded by downloading the File, in which the Model is stored.
4. The Models in the Website are free or paid.
5. Free Models are displayed with a "Free" stamp on them. Free Models can be downloaded without payment. It is only necessary the User to be registered in the Website.
6. Paid Models are displayed with their prices. Depending on the country the User is from, additional taxes may be charged. Paid Models can be baught and downloaded with or without registration.
7. The Users can use the Models by accessing the downloaded electronic file, in which the Model is stored. The format of the File, containing the Model, is described in the Model information in the Website. The needed hardware and software to access the downloaded File is responsibility of the User.

Intelectual property

1. The Website is property of Dandelien Creations Ltd., VAT BG201854856, address: 1 Tri ushi Str., Sofia, Bulgaria, telephone: 00359896811711, registered under the Bulgarian commercial law.
2. Dmodelz provides the User with access to the Services in accordance with the current Terms of use. The User agrees that Dmodelz is a complex product of intellectual property and all Resources in the Website are protected under copyright. The copyrights of the design of the Real Items belong to the respective trademark owners or owners of intellectual property.
3. All Resources are copyright protected. The resale, the provision for use by third parties, the distribution or licensing in any form of the Resources without the explicit consent of Dmodelz is prohibited.
4. The Models are copyrighted by Dmodelz, while the design of the Real Items, used as prototypes while creating the Models, is property of their authors or trademark owners.
5. The copyrights of the Real Items and their design remain property of their authors, trademark owners or intellectual property owners regardless of the fact that the Models, which are provided in the Website in a digital electronic form only, are property of Dmodelz.
6. Dmodelz provides the User with three-dimentional digital Models created entirely with an informative purpose and should be used to display renderings/images of the Real Items in design projects in order to give a better idea of how they look. The Models should not be used for any other purposes.
7. Dmodelz is not a manufacturer of furniture or any other interior or furnishing elements and is not a market competitor to the copyright owners and the trademark owners of the design of the Real Items. Dmodelz does not intend to mislead any perspective clients of theirs.
8. Real Items are not used to popularize and/or advertise Dmodelz. Real Items are not distributed in Dmodelz. Real Items are only used as prototypes while creating the Models.
9. Gaining access to the Resources does not give the User any rights to the intellectual property of the Resources, neither of the Real Items. All rights reserved!

Reservation of rights

1. Dmodelz reserves the right to make changes to these Terms of use at any time in its sole discretion. The changes shall be published on The website in a timely manner.
2. Dmodelz resrves the right to change, add or remove content and to modify the functionality and design of the Website at any time.
3. Dmodelz reserves the right to display on the Website links to other websites.
4. Dmodelz reserves the right to terminate or suspend without warning the accounts of Users who violate the Terms of use of the website and/or provide incorrect Personal data or Billing information.
5. Dmodelz reserves the right not to provide Models, requested by the Users.
6. Dmodelz reserves the right to inform its Users by e-mail about new features and options provided by the Website.
7. Dmodelz reserves the right, its sole discretion, to modify the Website, to upload new Models and Services or to remove existing ones without the User’s consent.
8. Dmodelz reserves the right not to answer questions, sugestions, complaints or other emails it receives.

Limitation of liability and disclaimer of warranties

1. Dmodelz is not responsible for the information provided by other websites to which Dmodelz contains links.
2. Dmodelz is not liable for any damages or loss of profits resulting out of or in relation to the use of or inability to use the Website by the Users and/or third parties.
3. The Resources are provided to the Users with the purpose to facilitate their work and with an informative and educational purpose. All Users use the Resources on their own responsibility. Dmodelz is not responsible for the Resources’ accuracy and exactness, possible mistakes or imprecision, comprehensiveness and usefulness, neither for the subjective perceptions and interpretations of the User.
4. Dmodelz is not liable for any damages, lost profits or other losses resulting out of or related in way to the use and/or application and/or inability to use the Resources by the Users.
5. Dmodelz is not liable for any damages or lost profits resulting out of or in relation to removed, modified, lost, incomplete or inaccurate information in Dmodelz.
6. Dmodelz is not liable for any damages, lost profits or other losses resulting out of or related in way to the use or the inability to use the Services of the Website.
7. Dmodelz does not warrant or guarantee in any way the Resources in the Website and does not take responsibility for the subjective perceptions and expectations of the User, neither for meeting those expectations or the needs of the User in regard to the program he uses. Although Dmodelz aims to provide maximum quality, the risk for the quality, condition, and the content is entirely up to the User.
8. Although Dmodelz does not tolerate and takes all measures to prevent any malicious actions that disturb the internet ethics or cause damages to the Users, including sending unsolicited e-mail messages, taking advantage of flaws in the systems to personally benefit or gain information, sending viruses or causing installation of viruses or programs for spyware and distant control, disturbing the work of other internet and associated networks users or making any other actions that could be classified as a crime or an administrative violation of the Bulgarian or other applicable laws, Dmodelz does not assume liability for any damages or lost profits resulting out of such actions.
9. In case violation of the copyrights owned by third persons is determined, Dmodelz will remove the data from the Website in good spirit.
10. Dmodelz does not maintain any software that checks for copyright violations or violations of trademarks through the Website and Dmodelz does not assume liability for such actions.
11. Dmodelz does not maintain any software that checks for abusive actions by Users or for incorrect Personal data. Dmodelz does not take responsibility for such actions.
12. Technical problems/errors might occur while using Dmodelz. Dmodelz takes all measures to solve any technical problems should they arise, but Dmodelz does not take responsibility for website failures due to server breakdowns or natural disasters, collapses or other circumstances beyond Dmodelz’s control and is not liable for any damages or lost profits resulting out or related to such problems, neither for damages or lost profits resulting out of the inability to access the Website or parts of it.
13. Dmodelz does not take responsibility for the steady and uninterrupted work of the Website.
14. Dmodelz reserves the right to remove or block any part of the Website and the corresponding content without prior warning.

Prohibitions

1. The User is prohibited to change, organize or modify the Website or any part of it in any way or form.
2. The User is prohibited to change the content of Dmodelz in any way or form.
3. Reselling, copying, modifying, creating new versions of, renting, reproducing, combining or splitting the Resources in/from Dmodelz without the explicit consent of Dmodelz is prohibited.
4. All rights reserved. Using similar domain name or website design that may lead to confusion among the Users of Dmodelz or harm its interests is prohibited.
5. Any malicious actions that disturb the internet ethics or cause damages to the Users of Dmodelz, including sending unsolicited e-mails, taking advantage of flaws in the systems to personally benefit or gain information, sending viruses or causing installation of viruses or programs for spyware and distant control, disturbing the work of other internet and associated networks users or making any other actions that could be classified as a crime or an administrative violation of the Bulgarian or other applicable laws are prohibited.
6. Uploading on the server of Dmodelz, sending or offering to third persons any materials that could be considered as a threat to one’s health or life, materials with pornographic content, discriminative materials, etc. is prohibited.
7. Removing watermarks or copyright marks from Dmodelz is prohibited.
8. In case the User does not wish to use the Services or the Resources provided by the Website any more or does not wish to comply with the Terms of use, all prohibitions on the use of the Resource remain in force! Reselling, copying, modifying, creating new versions of, renting, reproducing, combining or splitting the Resources in/from Dmodelz without the explicit consent of Dmodelz is prohibited. Anyone who violates the listed prohibitions will be duly prosecuted.  

Personal data and privacy policy

1. Upon signing up in Dmodelz, the User agrees to provide Dmodelz all Personal data necessary for the Registration (name, IP address, e-mail, country, etc.) The User agrees that Dmodelz will keep and process the provided personal data.
2. For buying paid Models, the User agrees to provide all necessary Billing information (name, IP address, e-mail, country, company name, VAT number address, etc.)
3. The User is fully responsible for the authenticity of all Personal data he provides.
4. The User is obliged to provide to Dmodelz authentic Personal data. In case Dmodelz establishes that incorrect Personal data has been filled in, Dmodelz can terminate the access of the User to the Website. In case of a law violation resulting out of incorrect Personal data provided by the User, Dmodelz will cooperate with the authorities to establish the identity of the violator and bring him to justice.
5. Dmodelz has the right to request from the User documents certifying the authenticity and accuracy of the provided Personal data.
6. Dmodelz has the right to check the authenticity of the provided Personal data.
7. Dmodelz is obliged to store and process the Personal data in correspondence with the Bulgarian laws.
8. Dmodelz is obliged not to submit the Personal data to third persons without the consent of the User except when required by the legal authorities.
9. The User is obliged not to provide his password or username to third persons.
10. Dmodelz does not carry responsibility for the Personal data in case of insecure connection, malicious actions by hackers, etc.
11. In case personal data is infringed upon, Dmodelz will cooperate with the competent authorities to determine the violation.
12. Dmodelz uses the provided e-mail address to send to the User newsletter with the latest news, uploads and Resources in Dmodelz. In case the User does not wish to receive the newsletter, he can declare it by clicking the relevant button in the newsletter.
13. Groups of data subjects: Persons who use Dmodelz; Inquirers (including by mail, calls, complaints, requests, alerts and other correspondence); Customers and Employees; Partners and subcontractors.
14. Data processed regarding the provision of the services: Correspondence; Contractual and financial information; Cookies; Other data provided by Users for the purpose of using the Website.
15. Purposes of processing personal data: Conclusion and execution of a contract; Legitimate interest; Legal obligations; Explicit consent.
16. Expiration date: the data is stored until the purposes for which it was collected are completed and until there is a legal basis for its processing.
17. Provision of information: Subcontracting, after the conclusion of a non-disclosure agreement; Third parties, when required by law by by a competent governmental authority or when protection of rights and legitimate interests is required.
18. Data protection: data is stored on secure servers located within the European Union. Appropriate technical and organizational data protection measures are taken. Employees have limited access to information as needed.
19. User Rights regarding personal data: information, access, correction, deletion, limitation, notification to third parties, objection to automated processing, including profiling, portability, withdrawal of consent, objection and complaint to a supervisor if the applicable data protection legislation is violated. Card Payments for paid Models. Rejected orders.

1. To download a paid Model, the User is obliged first to pay the price of this Models and all necessary taxes connected with the price.
2. To buy a paid Model, the User should add the selected Model to the Cart, fill in all necessary Billing information (if not already filled in) and finalize the buying process by paying the shown price and taxes if charged. After buying the Model, the User automatically receives permission to download it.
3. The payments for paid Models can be made with a Credit Card, via the virtual POS terminal in the Website.
4. After paying for a specific Model, the User automatically receives permission to download it. Orders are aproved automatically if the payment instrument (Card) is working properly and the necessery amount of funds are available in it. Dmodelz will reject orders in other case of insufficient funds in the Card or not properly working Card. In that case no charges will be made and no permission for downloadinig the selected Model will be given to the User.
5. The User can reject an order before the payment is made. In that case the User will not receive permission to download the specific Model until the payment is finalized.
6. After the payment is finalized, the Website gives imedeately automatically permission to the User to download the paid Model. After finalizing the payment the order can not be rejected.
7. The User agrees that the payment for a specific paid Model is a payment to receive permission to download this specific paid Model. Once the payment is made, it is considered, that the permission is received by the User and therefore the User has received the service, that is paid for.
8. Disclaimer of download or use after a payment for a Model is made is not a reason for money refund, due to the already received access to that Model.
9. The Images of a three-dimensional Model show all its characteristics, shape, form and level of detailness. The quality and characteristics of a three-dimensional Model are visible on its Images and can be seen by the User before the payment for that Model is made. Unfulfilled subjective expectations for quality and characteristics of a Model will be no reason for money refund.
10. Dmodelz reserves the right to change the prices of the Models at any time in its sole discretion. The changes shall be published on the Website in a timely manner.
11. The lack of hardware and/or software, needed to acces the File is not a reason for claiming money refund.
12. The User agrees, that buying a specific paid Model gives automatically access/permission to the User to download this specific Model. No physical product will be received by the User. Due to the lack of physical product, there is no possibility the User can return back the Model once it is baught. Once the payment is made, it is considered, that the Model is accessed and used by the User. The electronic file, which contains the Model, can be stored on the User's deices and/or easily replicated. Returning an electronic file containing a Model via a-mail or other digital holder is not a reason for money refund.
13. All payments made by the User can be seen in the Credit history in the User Profile. Invoices for the payments can be downloaded from the same page.

Arguments. Payment arguments settlement.

1. In case of a website problem in which the User has paid for a specific Model, but has not received permission to download that specific Model, the User should contact Dmodelz. Dmodelz will check if the payment is received and if received, Dmodelz will send the User the specific Model via e-mail.
2. Claiming funds refund for unfulfilled subjective expectations for the quality, detail level and characteristics of a Model will be considered as a dishonest attempt by the User to use that Model without paying its price. Due to the digital character of the Models and the automated system of the Website for giving permission то download a Model after it is bought, no funds will be refunded.
3. Any disputes or arguments, which can not be solved through mutual compromice and in good faith, shall be settled in accordance with the existing Bulgarian laws.

The User bears civil, criminal and administrative responsibility for non-execution of this Terms of use.
